    Kentucky Marriage Ban Struck Down

    Federal Judge John G. Heyburn II has just struck down Kentucky's ban on issuing same sex marriage licenses. Unfortunately the ruling is stayed, so no couples will be able to marry yet, but it is a terrific decision.

    Heyburn had previously set aside the part of Kentucky's marriage law that banned comity for outside marriages, and as such it had been illustrated on some maps as a victory state.

    The 6th Circuit, which has jurisdiction over Heyburn's court, will be considering several marriage cases on August 6.

    They won't put up with this in Kentucky................if gays can marry, it somehow cheapens the marital bonds between a man and his sister.

    It is unfortunate, but the 6th Circuit will hear five such cases in a month, and whatever the judges decide will apply to Kentucky. I hope it will not be for long.

    The 6th circuit has taken a tilt towards the right due to the fact Bush Jr was able to get six far right picks on there.
    It will depend on the panel we get but as Thinkprogress pointed out, next to the 5th and 8th, this is likely to be a circuit we could lose on depending on the panel we get or if they decide to go en banc to overule a favorable ruling.

    It might be a bit Machiavellian, but the 6th might also realize that a split post-Windsor virtually guarantees a quick decision from SCOTUS.

    Indeed.. and I don't think they want that.
    IMO though, there will be a split (there technically is with the 8th circuit) at some point, and I could see it being the 6th depending on the panel.
    Heck, we could see it on the 4th but with Obama being able to appoint so many judges to that court combined with the ones Clinton was able to get on there, an en banc hearing would easily overule a ruling against us.
    If it's not any of those circuits, then it will be the 5th. There is no chance in hell they will give us marriage equality, none at all.
