    Criminal Court protocol...especially within British Commonwealth nations....acknowleding respect for the court...my lord, my lady, your honour etc. reflect the status of the court's judge, or judges....

    The Pistorius trial was assigned to Judge Thokozile Masipa who has appointed two assessors, Janette Henzen du Toit and Themba Mazibuko, assisting her evaluate the case and determine a verdict.

    There is no jury system in South Africa.

    There is a similar form of address in Parliament. Everything anyone says when they argue or debate or pontificate is addressed to the Speaker of the House, not each other.

    So, "You're an idiot" becomes, "Mr. Speaker, I would regret if my honourable colleague were mistaken for an idiot by his constituents. However that might become inevitable if he keeps spewing this unfettered nonsense about public policy."

    I am glad this topic was launched. I was curious as to the "My Lady". I think we all watch so much U.S. TV Shows, that a good portion of us would plead the fifth and we live in a different country. I found this information quite interesting.

    Because South Africa is a Commonwealth Nation, the prosecutor represents the crown, in this case, Queen Elizabeth. Thus the term, "my lady" when addressing the prosectuing team, whether male or female.

    In lower courts, especially in landdroshowe (magistrates' courts), the judge is referred to as Weledele Heer (or Dame, for women) which translates to Honourable Sir or Madam.

    No. We have no deference to the Queen whatsoever in any matters legal or political.
    As stated by others, the reference is to the judge, who happens to be a woman.

    And I am really glad we have no jury system. I can think of nothing more frightening than having your fate determined by twelve average, prejudiced, racist, bigoted, religious morons (which is what you will get, in ANY country).

    .za is a commonwealth country but not a Commonwealth realm. The Queen has no standing in South Africa, it is a republic with a president. Or it was a republic with a president until the recent passing of Mandela, who, though he left office many years ago, is still the only proper president they've had.

    Anyway... in Canada the court case would be R. v Pistorius ("R" being the Queen, and short for "Regina" in Latin) charges in South Africa would have nothing to do with the queen and neither would any aspect of the court process or the forms of address in it.

    Playing the devil's advocate, would having just one person (the judge), who may be internally prejudiced, racist, and bigoted him/herself, determining your fate be better?

    I'm not here to debate which system is better, just stating that one can find fault with any system and I don't believe there exists a system that is "perfect".

    Whilst we get a very occasional anomoly, by and large the jury system works well in UK

    I did question in another thread whether it would be more likely that a single judge could be influenced more easily than a jury of 12

    I think very much yes. A judge may have personal bias, but the judgement is always subject to scrutiny by other judges; the judge cannot do anything that is unfair. And as you see on TV now, she has three advisors watching everything, so while they cannot make the final decision, anything that the judge does that is suspect will be red-flagged. If things are seen as unfair or odd, there is the supreme court of appeal, and higher than that, the constitutional court, both of which can review the case and change the judgement.

    And judges usually have a much, much better education and wider view of the world than jurors.
