Time Warner's modem fee
Time Warner was supposed to attach a $4.00 fee for leasing their modem, effective November 1st, 2012. It caused a ruckus and a class action suit ensued. I've check my bill and the new fee is not on it. Their website still has a faq about the fee, so it still exists. Is anyone paying the additional fee, or did I get lucky? Could it be that they are waiting until the suit is resolved?

Do you have one of the services where the fee is excluded?
I don't get why people were up in arms over this. I've never had any cable service where the modem was free.

No, my service area is not exempt. I received a newsletter from them in October saying it was effective November 1st. To your second point, yes it's ridiculous to get upset over this when a self-bought modem will pay for itself in about a year or so and people are fooling themselves if they don't think TW will increase rates to compensate for the lease fee if they do lose the suit. In the meantime I'm enjoying the "free" ride.

Sorry, I meant that on their site they seem to indicate that some tiers of their service don't have to pay it. You may have one of them.
I also would just buy one if I was their customer. The only time I've leased a modem is when I knew I was moving in a year and the modem would be a bad investment.

Yea, I'd buy a modem myself.

I called them. The bastards said that my normal ongoing fee ($54/ month) was "reduced" by $3.95 then "increased" (to reflect the lease fee) so the net effect is that my $54 hasn't changed. Sounds like fuzzy math to me. I asked if I bought my own modem if the fee would be reduced and they said "Yes." Unfortunately, TW is the only game in my backward town. So I'm off to Newegg to buy my own.
