After they've said "Careful with that, its hot", the responsibility passes onto yourself.

quasar, I agree with you on the majority of that, but I'd add that some responsibility should be put on the establishment if the customer is served when they are too drunk to follow the instructions. Like you said, there wasn't enough info in that case to know if she was sober when she drank it or not.

Here in the states the establishment can be sued if you're in an accident after being served too much. I'm sure the drink would be a legal nightmare here.
