Well, let's pull away from rape and sweaty balls for a minute. I mean, if you can bear doing so.
As a pedestrian, I've been struck by a car twice. Both times, I was knocked on my ass, but otherwise unhurt. Amd both times, I was doing the same thing when I was struck. I was walking across the street, with a walk signal. And a driver turned right, going from parallel-to-me to perpendicular, and struck me.
So here's the question. Who's fault was this? If I had been severely injured, who would shoulder the blame? Legally, there's no question. The driver was. I had the walk signal, which technically gives me the right of way. But pat's point, if there must be one, s tgat I should look out for my own safety. I should beware and be aware that right turners can and do create a hazard in those situations. And you can bet after being knocked on my ass a couple times, I keep my eyes peeled for them. Not because I know I'm wrong. Not because "I'm just asking to get hit walking across the street during those times". But because I don't like getting hit by cars. Being legally "right" may help the lawsuit and may pay or the hospital bills, but I'd just as soon not visit the hospital, thanks. I'll keep my eyes open instead.
This guy wasn't asking for balls-to-the-face. But the best way to avoid balls to the face isn't to have strong laws on the books to discourage balls to the face. It's to not put yourself in a position where it coud happen. This trial didn't undo him having balls on hs face. He's now just a guy who had balls to the face who got the guy put in jail.
