What he may or may not be wearing in the photo that is not viewable is immaterial. There are no naughty bits visible - I don't see how it could be pornography. I see nothing that I haven't seen in his photo shoots.

If he was in the hot tub and people were around, there's no expectation of privacy. If his friend took the photo on his or her phone, there's no expectation of privacy. If he took it on his phone and leaked it, he gave-up his right to privacy. The photo seems to be taken by another person.

Why weren't they a problem when he was the star of "The Gates" on ABC (a company that has a MUCH more wholesome background than MTV). The whole thing seems remarkably similar to Thomas Dekker and the debacle with his character on Heroes. Its probably his managment making a fuss and may not mean he himself has a problem with the images.

Unless we get a Cease & Desist for ALL images of him, there's no reason for us to do anything about his images. The pic of him kissing a guy isn't an issue to JUB as it wouldn't be allowed to be posted due to him being a minor at the time.

That said, his lawyer seems pretty homophobic judging from the language used in the only C&D notice to be made public so far!
